Vendor Terms & Conditions

These Vendor Terms & Conditions (“Terms”) apply to all distilleries (“Vendors”) offering products through the Distillery Marketplace platform (“Service”). By listing products or accepting orders through the Service, Vendors agree to comply with these Terms and all applicable Australian laws and regulations.

By submitting an order or listing products, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Vendor Responsibilities

Vendors are fully and solely responsible for:

  1. The accuracy of all product descriptions, pricing, images, and information
  2. The lawful production, packaging, labelling, and storage of their products
  3. Shipping, postage, delivery timeframes, and tracking
  4. Handling all customer enquiries relating to their products, orders, shipping, returns, and exchanges
  5. Providing and enforcing their own return, refund, and warranty policies
  6. Ensuring all content they upload is lawful and does not infringe third‑party rights
  7. Compliance with all alcohol‑related regulations and licensing requirements

Distillery Marketplace does not verify, guarantee or warrant any vendor‑supplied information or products.

Purchases
When a customer places an order, the Vendor not Distillery Marketplace is the seller. Vendors may be required to supply information necessary to fulfil the order.

All obligations relating to fulfilment, delivery, communication and after‑sales support rest solely with the Vendor.

Content
The Service allows Vendors to upload, link, store and share information, text, graphic and other material (“Content”). Vendors are entirely responsible for all Content they provide.

Distillery Marketplace may remove or disable Content that violates these Terms or applicable laws.

Vendor Liability Disclaimer
Vendors are solely responsible for all products they list and sell through Distillery Marketplace. This includes product quality, safety, legality, compliance, packaging, labelling and delivery.

Distillery Marketplace is not liable for any loss, damage, injury, claim or dispute arising from Vendor products, conduct or business operations. All legal, financial and customer‑service obligations rest entirely with the Vendor.

Marketplace Non‑Involvement Clause
Distillery Marketplace operates solely as a listing and discovery platform. We do not:

  1. Manufacture products
  2. Store inventory
  3. Pack or ship orders
  4. Mediate disputes
  5. Manage returns or refunds
  6. Provide product support
  7. Act as an intermediary between customers and Vendors

All product‑related and order‑related enquiries must be directed to the Vendor. Distillery Marketplace does not participate in or oversee Vendor–customer interactions.

Compliance with Alcohol Regulations
All Vendors must comply with all applicable Australian laws relating to the production, sale, promotion and delivery of alcoholic beverages, including:

  1. Excise and alcohol taxation requirements
  2. Packaging and labelling standards
  3. Age‑verification obligations
  4. Responsible service of alcohol laws
  5. Transport and delivery restrictions
  6. State and federal licensing requirements

Vendors are solely responsible for ensuring their products and business practices meet all regulatory obligations. Distillery Marketplace does not provide compliance advice and is not responsible for any breaches committed by Vendors.

Changes to Terms
Distillery Marketplace may modify or replace these Terms at any time. If a revision is material, we will aim to provide notice before new terms take effect. What constitutes a material change is determined at our sole discretion.
